1. Acceptance of these terms
By creating an account, signing in, or using STEM Quest in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the app.
STEM Quest is built for kids. Where these Terms refer to "you," the binding party is the parent or guardian who creates and oversees the account on behalf of the child.
2. Eligibility and accounts
To use STEM Quest, you must be at least 18 years old, OR be a parent or guardian creating an account for a child under your supervision.
Children under 13 may use the app only under the supervision and with the consent of a parent or guardian. The parent or guardian is responsible for:
- Creating and managing the account
- Supervising the child's use of the app
- Setting and protecting any parent PIN used to gate purchases or settings
- Reviewing our Privacy Policy for full details on data practices
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Acceptable use
You agree to use STEM Quest only for its intended purpose: educational gameplay. You agree NOT to:
- Use the app for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Use bots, scripts, or automated tools to interact with the app
- Attempt to gain unauthorized access to any accounts, servers, or systems
- Resell, redistribute, or commercially exploit any part of the app without written permission
- Misrepresent your age or identity
- Interfere with or disrupt other users' enjoyment of the app
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
4. Purchases and in-app items
STEM Quest may offer optional digital items for purchase ("Bundles"), such as character skins, gear, or coin packs. Purchases are processed by our merchant of record, Paddle.com Market Limited ("Paddle"), which handles payment, tax compliance, and refunds.
By making a purchase, you agree to:
- Pay the listed price plus any applicable taxes
- Confirm the purchase with the parent PIN if prompted (purchases by children require parent or guardian authorization)
- Paddle's own Checkout Buyer Terms
All Bundles are digital goods delivered to your account immediately upon successful payment. There is no physical shipment.
Refunds are governed by our Refund Policy.
No subscription, no auto-renew. All current purchases in STEM Quest are one-time payments. We do not offer subscriptions or recurring charges of any kind.
5. In-game currency and items
"Coins" and other in-game currency or items earned or purchased in STEM Quest have no real-world cash value, cannot be redeemed for real money, and cannot be transferred to other accounts or users. They are licensed to you for use within the app only and may be modified, removed, or adjusted at any time as part of normal app operations.
6. Intellectual property
All content in STEM Quest — including but not limited to artwork, characters, music, sound effects, code, questions, story text, and game mechanics — is the property of Shawn Valosin (Valosin Media) and is protected by copyright, trademark, and other intellectual property laws.
You are granted a personal, non-transferable, non-exclusive, revocable license to use the app for its intended purpose. You may NOT copy, modify, distribute, sell, or create derivative works from the app or its content without written permission.
7. User content
The only "content" users create within STEM Quest is a display name (e.g., "Magma Pup", "Super Star") and gameplay progress. You retain ownership of any display name you choose, and you grant us a limited license to display it within the app as part of normal gameplay.
You agree not to use display names that are offensive, contain real names of others without permission, impersonate others, or violate the rights of any third party.
8. Service availability
We make reasonable efforts to keep STEM Quest available and working, but we do not guarantee uninterrupted service. The app may be temporarily unavailable due to scheduled maintenance, updates, technical issues, or circumstances beyond our control. We may modify, suspend, or discontinue the app or any of its features at any time, with or without notice.
9. Disclaimers
STEM Quest is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
While STEM Quest is designed as an educational tool, we do not guarantee any specific educational outcomes or learning results.
10. Limitation of liability
To the maximum extent permitted by law, in no event shall Shawn Valosin, Valosin Media, or any affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the app, any unauthorized access to your account, bugs or harmful code transmitted through the app, or any errors or inaccuracies in the app's content.
Our total cumulative liability to you for any claims arising from or related to these Terms or the app shall not exceed the greater of (a) the amount you have paid to us in the twelve (12) months preceding the claim, or (b) twenty United States Dollars ($20).
11. Indemnification
You agree to indemnify, defend, and hold harmless Shawn Valosin, Valosin Media, and any affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the app.
12. Termination
You may stop using STEM Quest at any time. You may request deletion of your account by emailing stemquest@valosinmedia.com; see our Privacy Policy for details on data deletion.
We may terminate or suspend your account at any time if you violate these Terms or for any other reason, with or without notice. Upon termination, your right to use the app ceases immediately.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be posted at this URL with a new effective date and notified within the app or by email when changes affect your rights. Continued use after changes take effect constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law provisions.
Any dispute arising from these Terms or your use of the app shall be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes shall be resolved in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
